荷兰依亲居留——随行配偶、子女同在荷兰工作生活的居留许可

荷兰依亲居留,是允许持有“非暂时性居留许可”的申请人的随行家属前往荷兰同住、工作的居留许可。

持有荷兰KM高技术移民(Highly Skilled Migrant)工作签证的申请人,其随行子女与配偶可以通过申请荷兰的依亲居留与申请人共同在荷兰生活、工作、读书,并享受与当地居民同等的教育、医疗等福利待遇。

荷兰配偶居留申请要求·飞出国:

  • 配偶与主申为婚姻关系/经同居登记、或保有长期同居关系(需完成关系声明);
  • 主申持有有效的“非暂时性居留许可”,且已在荷兰住满1年以上;
  • 配偶与主申均为21岁及以上;
  • 配偶须通过荷兰融入考试;
  • 配偶即将前往荷兰与主申同住;
  • 主申有足够的长期的收入维持家庭生活,标准如下:

荷兰依亲居留申请流程·飞出国

  • 递交MVV及居留许可申请,并支付费用;
  • 收到确认函,审理开始(此间可能会要求补料);
  • 通知结果,领取MVV;
    (MVV全称是Machtiging tot voorlopigverblijf, 这是一种特别的过渡性签证。 凡是希望逗留在荷兰3个月以上的、介于18至65周岁的他国公民,包括来荷工作或留学,都需要首先申请获得MVV签证。MVV签证有效期90天。)
  • 前往荷兰,预约并领取居留卡;
  • 前往市政厅注册;
  • 肺结核体检、购买医疗保险。

荷兰依亲居留是否能够工作及入籍·飞出国

  • 配偶居留有效期、工作权限与主申相同——如高技术移民配偶居留有效期同为2-5年,无需再申请工作许可即可自由择业,18岁以下子女仅能从事实习或假期兼职;
  • 随行配偶、子女持居留卡5年后,满足一定条件后可申请永居/入籍。

Spouse or (registered) partner

You wish to live in the Netherlands with your spouse or partner. To live in the Netherlands with your spouse or partner, you need a residence permit. What are the conditions for this residence permit? And how does the application procedure work?

Other conditions apply to persons with the nationality of an EU/EEA country or Switzerland and their family members.

Conditions

There are certain conditions that apply to everyone. In addition, you and your partner have to meet the following conditions:

  • You are married to each other or have entered into a registered partnership together. Or you are unmarried and have a long-term and exclusive relationship with each other.

  • One of the following situations applies:

    • Your partner is a Dutch citizen.
    • Your partner lives in the Netherlands and has a residence permit for a non-temporary purpose of stay.
    • Your partner lives in the Netherlands with a residence permit for:
      • study
      • orientation year highly educated persons
      • cross border service provider
      • intra Corporate Transferees
      • temporary asylum
      • medical treatment
      • awaiting a decision on a request to establish Dutch citizenship (Art. 17 RWN)
      • temporary humanitarian grounds (except stay as a unaccompanied minor foreign national)
  • Your partner lives in the Netherlands with a valid residence permit for at least 1 year already. This condition does not apply if:

    • You and your partner both live abroad and travel to the Netherlands together.
    • Admission of the family member is in the interests of minor children.
    • Your partner already lives in the Netherlands and has a temporary residence permit for:
      • study
      • orientation year highly educated persons
      • Intra Corporate Transferees
      • stay as a highly skilled migrant
      • Holder of a European Blue Card
      • Scientific researcher under Directive 2005/71/EC or researcher under Directive (EU) 2016/801
      • paid employment
      • self employed person
      • cross border service provider
      • temporary asylum
      • employment as non-privileged military or non-military civilian staff (NATO)
      • awaiting a decision on a request to establish Dutch citizenship (Art. 17 RWN),
      • medical treatment
      • temporary humanitarian grounds (except stay as a unaccompanied minor foreign national)
      • foreign investor
      • stay under the Association Treaty between the European Union and Turkey (1/80)
      • stay on the basis of the Dutch-American Friendship Treaty or the Dutch-Japanese Trade Agreement
  • You are both 21 years or older.

  • You have passed the civic integration examination abroad or you are exempt from taking this examination

  • Your partner has sufficient income. This income is independent and long-term. This condition does not apply in the following situations:

    • Your partner has reached the AOW pension age. Calculate whether your partner has reached AOW pension age.
    • Your partner is permanently and fully unfit to work. Contact the IND for more information.
    • Your partner is permanently unable to meet the requirement for labour participation. Contact the IND for more information.
  • You are going to live with your partner and will register at the same address as your partner’s.

  • Your partner declares that he or she is your sponsor.

Child under 18

You wish to have your child live with you in the Netherlands. Your child needs a residence permit to live in the Netherlands. What are the conditions for this residence permit? And how does the application procedure work?

​Other conditions apply to persons with the nationality of an EU/EEA country or Switzerland and their family members.

Conditions

There are certain conditions that apply to everyone. In addition, you and your child have to meet the following conditions:

  • Your child is under 18.

  • Your child has not started a family of his own.

  • Your child is part of your family household and was also part of your family household abroad. In the following situations, the family relationship is considered to be broken:

    • Your minor child is living independently and financially provide for his own maintenance.
    • Your minor child is a private, independent family because he/ she marries a partner or start a relationship
    • Your minor child has the care or duty of care for an (illegitimate) child or other dependent family members and there is one of the above two situations.
  • Your child is going to live with you in the Netherlands. You register your child as living at the same address as you are.

  • One of the following situations applies to you:

    • You are a Dutch citizen.

    • You live in the Netherlands and have a residence permit for a non-temporary purpose of stay.

    • You live in the Netherlands with a residence permit for:

      • study
      • orientation year highly educated persons
      • cross border service provider
      • intra Corporate Transferees
      • stay with a family member, if the family member you are staying with is here for a temporary purpose of stay
      • temporary asylum
      • medical treatment
      • awaiting a decision on a request to establish Dutch citizenship (Art. 17 RWN)
      • temporary humanitarian grounds (except stay as a unaccompanied minor foreign national)
      • foreign investor
  • You live in the Netherlands with a valid residence permit for at least 1 year already. This condition does not apply if:

    • You and your minor child both live abroad and travel to the Netherlands together.

    • You already live in the Netherlands and have a temporary residence permit for:

  • You have sufficient income. This income is independent and long-term. You may add your partner’s income to your income if you meet all the following conditions:

    • You and your partner are married or have a (registered) partnership with each other.
    • Your partner is a Dutch citizen or has a residence permit in the Netherlands.
    • You and your partner live together.
  • You have custody of your child.

  • Is there a parent staying behind in the country of origin and who also has custody of your child? That parent then has to sign a declaration of consent. In this declaration the parent consents to the child leaving to go to the Netherlands.

  • You declare that you are the sponsor of your child.
