概述 Overview
只有移民部长或者部长代表可以签发，拒绝或者取消签证，有的情况下，申请人也可以和移民局申请取消签证。取消签证是由移民局自行决定的，如果取消申请人的签证，其家庭成员的签证也可能被取消。申请人的雇主，担保人或者家庭成员不能取消申请人的签证，但是，有父母责任的人可以要求移民局取消未满18周岁子女的签证。
Only the Minister or a delegate of the Minister can grant, refuse or cancel a visa which can be discretionary, mandatory or by operation of law. In some circumstances, you can ask us to cancel your visa.
Cancelling visas is at the discretion of the Department. If we cancel your visa, we may also cancel the visas held by any of your family members.
Your employer, a sponsor or family member cannot cancel your visa. However, a person with parental responsibility can request us to cancel the visa of a person under 18 years old.
签证取消的理由 Reasons why your visa may be cancelled
申请人如有以下情况，可能被取消签证：
- 不遵守签证条件
- 不满足品格要求
- 签证申请时提供虚假信息
如果申请人是在澳洲境内或者过海关的状态，移民局会提前通知打算取消签证，并且让申请人提出不该取消签证的原因。
Your visa may be cancelled if:
- you were non-compliant with visa conditions
- you did not meet our character requirements
- you provided false information on your visa application
If you are in Australia or immigration clearance we will usually notify you of our intention to consider cancelling your visa and give your the opportunity to put forward reasons why your visa should not be cancelled.
品格理由 Character grounds
如果申请人没有通过移民局的品格要求，移民部长有权拒绝或者取消签证，主要是以下情况：
- 申请人曾被判处12个月或以上监禁（不论实际服刑时间长短）；或
- 申请人已被定罪，被证明指控或已被裁定犯有涉及儿童的性犯罪
申请人有28天的时间来陈述自己认为取消签证的决定应该被撤回的原因，移民局会考虑整个申请的所有情况来做出决定。其他不符合品格要求的情况下，申请人也是有机会在移民局取消签证之前提出不应该取消签证的原因。
The Minister has the power to refuse or cancel your visa if you do not pass our character test.
The Minister may cancel your visa if you:
- have ever been sentenced to 12 months or more imprisonment (regardless of time actually served), or
- have been convicted of, had a charge proven for or have been found guilty of a sexually based crime involving a child
You will have 28 days to make representations why you think the decision to cancel your visa should be revoked. We will consider all the circumstances of your case before we respond.
In other cases where you appear to fail the character requirements, you will be given an opportunity to put forward reasons why your visa should not be cancelled before we cancel your visa.
支付担保费用 Paying for sponsorship
如果申请人有参与支付担保费用，移民局可能取消签证。移民局做决定之前会充分考虑：
- 申请人是否发起或者参与支付担保费用
- 告发的意向（举报人，积极向移民局提供信息）
如果申请人的费用支付是由于威胁或者剥削（人口贩卖或奴役）造成的，则移民局可能不会取消签证，但是申请人需要提供相关证明信息。
申请人也有机会提出不应该被取消签证的原因，可以提供以下相关证明：
- 申请人与澳洲的紧密联系
- 申请人对澳洲的贡献
We might cancel your visa if you are involved in paying for visa sponsorship.
We consider all circumstances before making a decision. This will include:
- if you initiated or were complicit in the paying for sponsorship
- your intent in coming forward (whistle-blower, actively providing us with information)
We may not cancel a visa if your payments were due to threats or exploitation (human trafficking or slavery). You should give us all relevant information if that is the case.
You will have a chance to put forward reasons why your visa should not be cancelled. You should include evidence showing:
- the strength of your ties to Australia
- your contribution to the Australian community
学习变更 Changes to study
如果申请人没再就读注册课程，则可能被取消学生签证。申请人完成课程后，其登记在册就已经结束，即使入学确认书COE上结束日期还未到。如果有完成课程，申请人通常有三个月的时间用于离开澳洲或者申请其他签证。以下情况可能会被取消签证：
- 申请人完成了学签对应的课程，但是在三个月内没有离开澳洲或者申请新的签证
- 获得学签后有变更课程，主课的新入学确认书COE结束日期较早，且申请人在完成课程后的28天内没有离开澳洲或者申请新的签证
- 有学习不止一个学历，提前完成一门学历并且多个学历之间的间隔超过2个月（除非是学年结束和新学年开始之前的间隔）
在移民局取消学签之前，移民局会考虑以下：
- 申请人有合法的提前完成课程
- 申请人学习成绩好
- 在课程间隔入读其他课程是合理的
如果申请人没有满足学签的其他签证条件，也是可能被取消签证的。申请人可以通过VEVO系统查看签证条件。
We may cancel your student visa if you are no longer enrolled in a registered course.
Your enrolment ends when you complete the course, even if this is earlier than the end date on your Confirmation of Enrolment.
What you must do after you complete your course depends on your enrolment arrangement.
If you complete the course for which your visa was granted, you will have 3 months to depart Australia or apply for another visa.
We may cancel your visa in these situations:
- you complete the course for which we granted your student visa and you do not leave Australia or apply for a new visa within 3 months.
- you have changed courses since we granted your student visa and your new Confirmation of Enrolment for your principal course has an earlier end date and you do not leave Australia or apply for a new visa within 28 days of completing the course.
- you are studying more than one course on your visa (course packaging) and you finish a course early and have a gap between courses of more than 2 months (except if this gap occurs between the end of an academic year and the beginning of a new academic year).
Before we cancel your student visa, we will consider your situation. This includes if:
- you legitimately finished the course early
- you have a good academic record
- it is reasonable to expect you to enrol in another course during the course gap

违反生物安全 Biosecurity contraventions
入境澳洲需要申报来自海外的某些食品，植物材料和动物物品，因为这些物品有可能：
- 将严重的病虫害引入澳洲
- 破坏澳洲的农业和旅游业以及生态环境
如果申请人有以下情况，移民部长有权在过海关的时候取消访客，学生和工作签证
- 未达到入境旅客卡上关于物品问题的要求
- 随行货物或行李没有遵循生物安全官员的指示要求
- 向生物安全官员提供虚假或误导性的信息或文件
It is important to declare certain food, plant material and animal items from overseas as these items may:
- introduce serious pests and diseases into Australia
- devastate our valuable agriculture and tourism industries and our unique environment
The Minister has the power to cancel some visitor, student and work visas in immigration clearance if you:
- fail to meet the requirements to answer questions about goods on your incoming passenger card
- do not follow directions given by a Biosecurity officer in relation to goods or baggage
- provide false or misleading information or documents to a Biosecurity officer

进口违禁货物 Importation of objectionable goods
如果申请人未经许可进口违禁物品和材料，移民部长有权取消其签证。
违禁物品包括描述、描绘、表达或以其他方式处理以下事项的材料：
- 性
- 药物滥用或成瘾
- 犯罪
- 残酷
- 暴力
- 以一种会冒犯理性成年人的方式的令人反感或可恶的现象
同时还包括包括以以下方式描绘 18 岁以下儿童的商品：
- 冒犯一个理性的成年人
- 宣扬犯罪或暴力
- 鼓吹药物滥用
- 鼓吹进行恐怖行为
签证被取消后 If your visa is cancelled
如果申请人签证被取消了，后续可能很难再申请澳洲其他签证或者获得前往，进入或者停留在澳洲的签证。
Cancellation of your visa might also bar you from making further visa applications or prevent you from being granted certain visas to travel to, enter or stay in Australia .
因为品格原因被拒或者取消签证 Refused or cancelled visa due to concerns about your character
如果申请人是因为品格原因导致签证被拒或者取消，则后续唯一能申请的则是庇护签证。如果申请人是因为品格原因被驱逐出澳洲，再次申请进入澳洲的签证时将很难满足品格要求。
刑事司法入境签证 Criminal Justice Entry visas
如果申请人持有刑事司法入境签证，或者取消刑事司法入境签证后停留在澳洲，申请人唯一可以再申请的则是庇护签证。
If you have a Criminal Justice Entry visa, or you stayed in Australia after we cancelled your Criminal Justice Entry visa, the only visa you can apply for is a Protection visa.
庇护签证被拒 Refused a Protection visa
如果申请人庇护签证被拒，则无法再次申请庇护签证。如果移民部长认为让申请人的再次提交符合公共利益，申请人才能再次申请庇护签证。
You can’t apply for a Protection visa again if, since you last entered Australia, you were refused a Protection visa.
You can only make an application for another Protection visa if the Minister decides it is in the public interest to let you submit a further application.
请求取消签证 Request a visa cancellation
如果申请人持有的是6个月以上有效期的临时签证，需要通过immiAccount请求取消签证。对于6个月有效期以内的签证取消请求，移民局不会处理。
If you hold a temporary visa with more than 6 months validity, you may request visa cancellation through ImmiAccount.

上诉 Appeals
如果移民局拒签或者取消签证，申请人可以申请review，如果是移民部长个人决定的，则申请人无法上诉。AAT是负责签证上诉的部门，包括签证取消上诉。申请人需要在移民局决定信所规定的时间期限内提出上诉。
If we refuse or cancel your visa, you might be able to request a review of our decision. You cannot appeal a decision if it was made by the minister personally.
The independent Administrative Appeals Tribunal (AAT) is responsible for reviewing departmental decisions including visa cancellation decisions.
To seek a review by the AAT, you must lodge your application by the date specified in your decision notification letter.
For decisions that are to be reviewed by the AAT, the AAT cannot extend the time for making a valid review application. You must apply for review within the time period identified in the decision notification letter.
