什么是身份恢复？ restoration of status-飞出国

在加拿大，持有visitor、student或worker身份的临时居民 ，若其合法身份失效，可在过期后的90天内 申请“恢复身份”。这项政策无疑为失去身份的人提供了一个宝贵的补救机会。

Restoration

  • 182 (1) On application made by a visitor, worker or student within 90 days after losing temporary resident status as a result of failing to comply with a condition imposed under paragraph 185(a), any of subparagraphs 185(b)(i) to (iii) or paragraph 185(c), an officer shall restore that status if, following an examination, it is established that the visitor, worker or student meets the initial requirements for their stay, has not failed to comply with any other conditions imposed and is not the subject of a declaration made under subsection 22.1(1) of the Act.

什么情况下会失去身份？-飞出国

  1. 工作许可过期；
  2. 超过工作许可条款中must to leave时间，若与许可过期时间不同，则以此为准；
  3. 工作许可中限定条款变更：比如封闭工签更换雇主，更换工作地点等；
  4. 未遵守工作许可附加条件。

The expiry date on your work permit is the date you must stop working in Canada. In most cases, it’s also the date your temporary resident status expires in Canada.

If there’s a “Must leave Canada by” date on your work permit

Your status in Canada expires on the “Must leave Canada by” date. This applies even if it’s different (later) than the expiry date on your work permit.

You’ll lose your status if

  • it expires before you apply to extend or change it
  • you don’t respect the conditions on your work permit

  1. 学习许可过期；

    学习许可的到期日取决于：学习许可上的有效期，或完成课程后的第90天；具体来说：
    :right_arrow:课程没结束，学习许可到期，失去学生身份；
    :right_arrow:提前完成课程，最后一门课程出成绩的第90天，即便学习许可上的有效期还没到，也失去了学生身份；
    :right_arrow:提前完成课程，但加拿大学签过期日早于毕业后第90天，以学签过期日为准；

  2. 未经批准变更学习条件（如转学、改专业、变更学习地点等）。

  3. 违反学习许可条款。

You lose your student status in Canada if any of the following applies to you:

  • Your study permit expired before you applied for a new one.
  • You changed the conditions on your study permit such as
    • your DLI
    • type of study
    • location of study
    • time period of study
  • You didn’t respect the conditions of your study permit.

Once you lose your status, you can’t study in Canada until we’ve restored your status as a student.

If you apply after your permit expires, you can stay in Canada but you can’t study until your status has been restored and you have received your new study permit.

访客签证，6个月停留期过期，或超过入境时边境官写下的日期；
超级签证，5年停留期过期，或超过入境时边境官写下的日期；
visitor record过期。

90天期限如何计算？-飞出国

情况一：有效期内，已递交延期申请

  • 在延期申请审理期间是maintained status，依然具备合法的临时居民身份，因此若延期申请通过，则开启新的身份；

  • 若延期申请拒签，则从拒签日开始计算90天；

  • 若延期申请因为材料不完整而退料，则不具备maintained status，因此原临时居民身份到期后，开始计算90天。

情况二：有效期内，未提交任何新申请
从临时居民身份正式到期日起计算90天。

恢复身份申请条件-飞出国

  • 在失去身份后的90天内提交申请
  • 一直遵守原身份的所有条件
  • 不是临时居民许可持有人
  • 申请期间必须留在加拿大（离境即视为放弃）
  • 恢复身份期间不允许工作或学习，必须等待申请获批后才能恢复相关活动

恢复身份申请流程-飞出国

身份恢复并不是独立的申请，必须与新的许可申请同时提交，如：

恢复身份+续签学签
恢复身份+续签工签
恢复身份呢+申请访客记录

移民局将优先审理恢复身份申请，只有这部分通过后，才会继续处理后续的许可申请。同样，若恢复身份申请不通过，后续续签申请则直接拒签。
