The employer who is ready to hire you must complete the following steps:
- Fill out and sign the Labour Market Impact Assessment Application – Stream for Higher-Skilled Occupations (EMP5517) of Employment and Social Development Canada (ESDC), then send it, with payment of the fees required by the Government of Canada and the required supporting documents, to the ESDC Service Canada Centre (foreign workers);
Note: Employers can use the simplified procedure if the job you are being offered is one of the 44 professions eligible for the simplified processing. Note that the procedure that your employer must follow was modified on July 31, 2013. From now on, your employer must simultaneously submit the application to the Ministère de l’Immigration, de la Diversité et de l’Inclusion and Service Canada.
Send to the Ministère the following documents:
- a copy of the Labour Market Impact Assessment Application – Stream for Higher-Skilled Occupations (EMP5517), duly completed, signed and accompanied by payment of the fees required by the government of Québec to review a temporary job offer. Your employer must write “Simplified processing” by hand on the form;
- a copy of the supporting documents sent to ESDC;
- a copy of the Self-declaration by the employer – For temporary work, duly completed and signed;
- the Application for Certificate of acceptance (CAQ) for temporary work from Québec, that you will have duly completed and signed, and payment of the fees required by the Québec government to review the CAQ application. Your employer must write “Simplified processing” by hand on yourform;
- the supporting documents required to process the CAQ application.
Note: For more information on the Labour Market Impact Assessment (LMIA), refer to the section reserved for employers for the recruitment of temporary skilled workers (in French).
If your employer’s job offer is accepted (positive or neutral LMIA), the employer will send you two copies of your CAQ as well as a confirmation letter from Service Canada and the Ministère de l’Immigration, de la Diversité et de l’Inclusion. You will need all of these documents to apply for a work permit from the Government of Canada.
