萨省房产经纪类职业注册指南 (Real Estate)

萨省房地产委员会SREC(Saskatchewan Real Estate Commision)，是一个独立的、非政府机构，负责房产经纪行业的监管。涉及的职业有房地产的经纪人，分公司经理，准经纪人或销售人员(broker, branch manager, associate broker or salesperson)。

申请人首先要参加考试，考试通过后，需要在2年之内向委员会申请注册/许可。

房产经纪职业注册要求(Registration Requirements)

一、房产经纪职业注册要求(Registration Requirements)

  1. 所从事的职业必须和注册的职业一致，比如从事 broker，必须注册为broker，从事 branch manager ，必须注册为 branch manager ；
  2. 提交申请表；
  3. 支付费用；
  4. 提供一个萨省的联系地址；
  5. 提供材料证明申请人一直遵守房地产法案的规定。

二、第一次注册(Initial Registration)

A. 企业经纪业务注册申请(Brokerage Application for Registration as a Corporation)

corporation 可以用其法人的名字或者business的名字申请注册为brokerage。corporation 需要提供：

  • 负责经纪业务的官员的名字；
  • 被企业指定作为经纪人的个人的名字，以及这个人注册为经纪人的个人申请；
  • 所有被企业指定作为分公司经理的个人的名字，以及这些人员注册为分公司经理的个人申请；
  • 打算开展业务的地点，以及business名字；

B. 合伙企业经纪业务注册申请

C. 独资企业经纪业务注册申请

D. 经纪/分公司经理注册(Broker/Branch Manager Registration)

申请人需要满足下列条件：

  • 满足规定的教育水平或者由SREC认可的等同的教育水平；
  • 在过去5年中，已经从事销售人员、准经纪人、经纪人或分部经理达2年，或者有等同的类似经验；

需要提交的材料：

  • 申请表： Brokerage/Broker Application。
  • 注册费：240加币，可以用信用卡或支票支付。
  • 房地产保证金；
  • 公司注册证的副本(Certificate of Incorporation)，和/或者合伙经营的注册证明，以及企业分支机构确认申请人的公司名称合理注册的确认件的副本；
  • 证明经纪公司在萨省有办公室，可以提供办公室地址被批准的证明文件的副本；

  • A copy of the Certificate of Incorporation and/or proof of registration of the partnership with the Corporations Branch must be provided. In addition, a copy of the acknowledgement from the Corporations Branch that the applicant’s business name is properly registered must be provided to the Saskatchewan Real Estate Commission.

  • Pursuant to Section 30(1) of The Real Estate Act, the Commission shall not grant registration to a brokerage unless it maintains an office in Saskatchewan that is satisfactory to the Commission and from which the brokerage conducts its business. The Saskatchewan Real Estate Commission will accept the location of a brokerage’s office provided that it is complying with the regulations; bylaws and zoning requirements of the municipality it is located in and the municipal bylaws permit the access of salespeople and consumers to this office location
    The Commission must be supplied with a copy of the documentation from the city/town/municipality approving the office location of the brokerage.

E. 准经纪人/销售人员注册(Associate Broker or Salesperson Registration)

申请人需要满足下列条件：

  • 满足规定的教育水平或者由SREC认可的等同的教育水平；
  • 提交申请表：Registrant Application Form. ；
  • 提供broker签署的notice，证明一旦申请人注册成功，就可以代表 brokerage 从事销售人员；
  • 授予准经纪人/销售人员的注册证书上会包含上面提到的brokerage的名字。

三、注册更新(Registration Renewal)

除非提前终止或者撤销，否则的话，所有的注册证书从注册日开始，到下一个6月30日的午夜到期。所有的人员需要在到期前申请 renewal，在线申请。

1. Brokerage/Broker

  • 重新提交申请表 Brokerage/Broker Application；
  • 支付费用：
    • The registration renewal fee for a brokerage is $240.00
    • The registration renewal fee for a broker is $355.00
    • REIX E & O Insurance Premium $275.00
    • Pursuant to Bylaw 403, every broker making application for registration renewal effective July 1st shall be assessed an annual Real Estate Assurance Fund levy of $10.00.

2. Branch Manager, Associate Broker or Salesperson

  • Registration Fee $355.00
  • Real Estate Assurance Fund Levy $10.00
  • REIX E & O Insurance Premium $275.00
  • Total $640.00

四、改变注册状态(Change of Registration Status)

已经持有注册证书的人员，可以在当前的注册年度( current registration year)申请更改注册状态，比如由broker 改为 salesperson。

  • 填写注册证书终止申请表：Termination of Certificate of Registration；
  • 填写想要更换为的新职位的注册申请表；
  • 支付100加币的注册费。

五、终止注册证书(Termination of Certificate of Registration)

a broker, branch manager, associate broker or salesperson 停止代表一个brokerage，可以申请终止注册证书。

  • 以上人员的注册证书被暂停；
  • brokerage 需要在以上人员停止代表其业务后的5天内，书面通知SREC，并说明原因。

2. 语言能力 (Language Proficiency)

所有的学生在注册SREC的考试前，都需要满足英语要求，申请人可以提供思培 CELPIP-G类 level 4的成绩，或者满足豁免英语条件。

English is the language of contracts in Saskatchewan and the language of instruction for real estate education in the province. In order to ensure that registrants are competent to satisfactorily communicate in English with other registrants and consumers, the Saskatchewan Real Estate Commission has instituted a Language Proficiency Requirement.

以下申请人可以豁免英语要求：

  • 毕业于加拿大或美国的高中，并且完成了12年级的 Language Arts或者等同的学科；或者
  • 对于魁省居民，1996年之后，在Collèges d’enseignement général et professionnel完成了已英语为第一语言的4门课程，如果是1996年之前完成的，则2门课程就可以。1977年以前完成的高中文凭，Charter of the French Language认证其学校为英语语言学校，也可以；或者；

  • 从以英语为主要教学语言的认可的大学、学院或技术院校，获得了经认可的学位；或
  • 在以英语为主要教学语言的认可的大学、学院或技术院校，完成了 English composition or English literature 3学分课程；或
  • 当前注册，或者符合注册条件，或者在另外一个机构unlicensed的时间不超过2年并且满足那个机构的语言要求。

无犯罪记录(Criminal Record Check)

持续职业发展CPD(Continuing Professional Development)

作为年度注册程序的一部分，所有的注册人都必须在每年的5月31号之前完成 Real Estate Update course (CPD)。晚于3月31号注册的人员，免除当年的CPD课程学习要求。

CPD课程主要是培训当前最新的和综合性信息，比如，立法的变化，法律更新，降低风险和专业标准等。确保注册人员学到的知识后期能够参考和使用。CPD可以提高注册人的形象，提高公众保护，并减少可能发生在注册人身上的索赔案件。

The CPD course is developed to deliver current and comprehensive information such as legislative changes, compliance issues, legal updates, elements of risk reduction and professional standards. This is to ensure registrants obtain information from the course material that they can reference and use later on. CPD is in place to improve the professional image of registrants, improve public protection and to reduce potential claims against registrants.

CPD课程有现场教学和在线授课两种方式。打算参加课程可以联系 Association of Saskatchewan REALTORS® (306-373-3350)，或者登陆它们的网站： www.saskatchewanrealestate.com.

对于未能在5月31日前完成CPD课程的注册人员，需要：

  1. 向SREC委员会递交申请，请求1个月的延期，并支付300元的延期费；
  2. 向课程培训机构申请一个在线课程，并在6月30号之前学完课程。

调查程序(Investigation Process)

SRCE委员会负责萨省房地产行业的监管，并且确保公众利益的保护。其中一个职责，就是对失职和不称职指控进行调查。委员会会举行正式的听证会，来确定某个注册人是否有失职罪和不称职罪，并且行使委员会的权利对其给予处罚。如果注册人放弃正式听证会，并且承认自己有罪，会举行小型的听证会来决定罚款情况。如果注册人承认有罪，并且就罚款问题与委员会达成一致，注册人需要签署同意令。

互惠政策(License Reciprocity)

SREC将注册互惠政策定义为 认可有职业标准的所有加拿大机构的房地产经纪从业人员。
The Saskatchewan Real Estate Commission defines licensing/registration reciprocity as the recognition of occupational standards from other jurisdictions that have occupational standards.

信托账户(Trust Accounts)

Maintenance of Trust Accounts

萨省房地产法案规定所有的房地产经纪公司都必须在萨省的金融机构开设1个或多个有息信托账户(interest bearing trust accounts)。注册人需要将房地产交易相关的所有信托资金都要立即交给他们的broker/brokerage。broker/brokerage负责保证将收到的所有信托资金，在收到房地产合同后的2个工作日内存入信托账户。

broker还负责房地产交易相关的信托资金的收集、保管和分配。

broker/brokerage 需要保留所有涉及信托账户的记录，如存款单的复印件、原始的取消或作废支票，以及记录收到的信托资金的手动或电子系统。broker 每月至少协调一次信托负债和银行账户额度。

A broker/brokerage must maintain records relating to the trust account(s) as outlined in Part Six of the Commission Bylaws. At the very minimum, brokerages must retain copies of deposit slips, original cancelled and/or voided cheques and a manual or electronic Trust Ledger System for trust monies received. At least once a month, the broker must reconcile the trust liability to the bank account

专业公司(Professional Corporation)

备注： 即使有专业公司的许可证，也不能使你在房地产行业注册，也不允许你向公众提供房地产服务。必须要向SRCE申请注册为brokerage并且获得注册证书才可以在房地产行业从事相关业务。

  1. 向SREC提交批准公司的名称的书面请求，名称包括Professional Corporation, Prof. Corp. or P.C.。获批后会收到确认信和许可申请表。
  2. 向 Saskatchewan Justice, Corporate Registry for Articles of Incorporation 申请；
  3. 向SREC申请许可。申请中需要包括：
    • 专业公司申请签发或更新年度许可的完整的申请；
    • 公司注册证书复印件；
    • 许可费。

思培考试(CELPIP) 是除了雅思以外CIC唯一承认的英语考试。考试的评分是直接对应CLB level，最高12分就是对应CLB level 12，其他依此类推。
