Regarding the receipt and processing of applications for selection certificates submitted by foreign nationals of subcategories of economic immigration “skilled worker”, “investor”, “self-employed” and “entrepreneur” and certain applications for selection by foreign nationals of the category of foreign nationals who are in a particular situation of distress
The Minister of Immigration, Diviversity and Inclusion
Considering section 3.5 of the Act respecting immigration to Québec (chapter I-0.2) which provides that the Minister may, in particular, taking into account the orientations and objectives set out in the annual immigration plan and the needs and Québec’s reception and integration capacity, make a decision on the receipt and processing of applications for a selection certificate for the period it fixes;
Whereas a decision may apply to a category of foreign nationals or within a category;
Given that a decision may include the maximum number of requests the Minister intends to receive, the suspension of the receipt of applications, the priority of the processing of applications and the disposition of those for which it has not commenced. 'examination;
Considering that a decision is made for a maximum period of 14 months and that it takes effect on the date of its publication in the Gazette officielle du Québec or on a later date fixed there in;
Since March 24, 2017, by Ministerial Order No. 2017-004 published in the Gazette officielle du Québec No. 13B of March 30, 2017, the Minister of Immigration, Diversity and Inclusion took the Decision respecting the receipt and processing of applications for selection certificates submitted by foreign nationals of the economic immigrant subcategories “skilled worker”, “investor”, “self-employed” and “contractor”;
Whereas, as of January 1, 2018, for the economic class, 26,607 applications for a selection certificate, of which 24,198 were submitted by skilled workers and 2,409 applications by investors, were still awaiting processing;
Since, as of January 1, 2018, nearly 56,000 persons selected in the economic class were still waiting for a decision on their application for permanent residence, including 38,500 persons selected under the “workers” sub-category. qualified "and 17,500 people selected in the category of business people;
Considering that this inventory of applications has the effect of prolonging the processing times for all applications in the economic immigration category and delaying the integration of immigrants in this category into Quebec;
Given that on December 11, 2017, by Ministerial Order No. 2017-011 published in the Gazette officielle du Québec No. 52 of December 27, 2017, the Minister of Immigration, Diversity and Inclusion took the Decision concerning the temporary suspension of the receipt of certain applications for selection certificates submitted by foreign nationals of the category of foreign nationals who are in a particular situation of distress;
Since Quebec plans to select between 5,600 and 6,500 refugees or protected persons abroad in 2018;
Since on January 1, 2018, more than 14,500 persons covered by a commitment entered into by a guarantor, whether a corporation, a resident of Québec and a legal person or a group of two to five residents of Quebec were waiting for their application for permanent residence to be processed by the Government of Canada or to be admitted to Quebec;
Since the number of applications for selection certificates made by refugees or protected persons abroad covered by a commitment entered into by a guarantor is significantly higher than the estimates provided for in the annual immigration plan and the capacity reception and integration of Quebec;
Considering that the new Quebec Immigration Act (2016, Chapter 3) was passed and sanctioned on April 6, 2016, but is not yet in force;
Given that the Minister of Immigration, Diversity and Inclusion intends to amend the provisions relating to applications for selection certificates submitted by foreign nationals of subcategories of economic immigration “skilled worker”, "investor “,” Self-employed worker “and” entrepreneur ", as well as applications for guarantor undertakings for refugees or protected persons across borders in the regulation that will replace the Regulation respecting the selection of foreign nationals (I-0.2, r 4);

Decision concerning the reception and the processing of applications for selection certificates submitted by foreign nationals of the subcategories of economic immigration “skilled worker”, “investor”, “self-employed” and “entrepreneur” and some certificate applications from selection by foreign nationals of the category of foreign nationals who are in a situation particular distress
1. The maximum number of applications for selection certificates submitted by foreign nationals of the “skilled worker” economic immigration sub-category that the Minister will receive is 5,000.
Applications submitted above the ceiling indicated above will be returned to foreign nationals.
1.1 Exclusions
The following requests are excluded from the ceiling indicated above:
- applications submitted under the Quebec Experience Program provided for in sections 38.1 and 38.2 of the Regulation respecting the selection of foreign nationals (chapter I-0.2, r.4);
- applications from foreign nationals who have a validated job offer in accordance with factor 7 of the Economic Immigration Selection Grid in Schedule A of the Regulation respecting the selection of foreign nationals;
- applications from foreign nationals for whom Immigration, Refugees and Citizenship Canada agrees to process the application for permanent residence in Canada;
- applications from temporary residents who may, according to the Regulation respecting the selection of foreign nationals, submit their application for a selection certificate in Québec.
1.2 Reception period
Applications for selection certificates submitted by foreign nationals of the “skilled worker” economic immigration subcategory will be received by the Minister for a period to be determined by the Minister at a later date.
Requests outside the period of receipt subsequently determined by the Minister will be returned to foreign nationals.
However, applications subject to an exclusion provided for in section 1.1 may be submitted and received at any time by the Minister.
1.3 Priority for processing requests
The following requests are given priority treatment:
(a) applications submitted under the Quebec Experience Program provided for in sections 38.1 and 38.2 of the Regulation respecting the selection of foreign nationals;
(b) applications from foreign nationals who have a validated job offer, in accordance with factor 7 of the Economic Immigration Selection Grid in Schedule A of the Regulation respecting the selection of foreign nationals;
and (c) applications from foreign nationals who earn points at factor 1.2 Training Area, as set out in the Regulation respecting the weighting applicable to the selection of foreign nationals.
2. The receipt of applications for selection certificates submitted by foreign nationals of the subcategories of economic immigration “investor”, “self-employed worker” and “entrepreneur” is suspended.
3. The receipt of applications for selection certificates submitted by foreign nationals of the category of foreign nationals who are in a special situation of distress referred to in paragraph b of section 18 of the Regulation respecting the selection of foreign nationals, which are not borne by the State or not covered by a commitment request made by a guarantor before 27 January 2017, is suspended.
However, applications for selection certificates that include a family member of a foreign national who was not covered by the undertaking underwritten in favor of the latter before January 27, 2017, as well as certificate applications, are received. by foreign nationals covered by an undertaking that is null and void under paragraph c of section 46.3 of the Regulation respecting the selection of foreign nationals.
4. This decision takes effect on April 1, 2018 and ceases to have effect on August 15, 2018.
