2019年魁北克常规技术移民新政,终止未处理的申请,全部采用 Arrima 系统进行邀请

飞出国:2019年1月下旬,魁北克移民部开始在魁北克媒体讨论申请积压问题,当时飞出国论坛发布过 18139份申请积压,魁北克技术移民 Arrima 系统2019年或暂缓邀请 的贴子,随后中国春节期间魁北克移民部就发布了国会关于终止魁北克技术移民遗留申请处理的9号法案,飞出国论坛也第一时间发布消息 魁北克 欲作废2018年8月2日之前的 所有18000份申请,上万申请人 只能重新来过

虽然这还只是一个提案但通过的概率比较大,而且魁北克移民部已经迫不及待的在官网发布消息(帖子下方有中,英,法版原文)有势在必行的架势。

总体来说,魁北克技术移民新的一刀切后,魁北克将取消之前的 Mon Projet Quebec 系统,统一使用 Arrima 的EOI系统来高分邀请,之前613和816抢上配额的也需要一起来排队,这样增加了新系统的竞争,带来的结果是条件好的申请人会快速获邀快速,条件一般的申请人需要排更长时间的对或其他做好其他打算。法语在魁北克移民中越来越重要,不学法语就可以移民魁北克的时代渐渐远去了。同时魁北克经验类移民不受影响,有法语基础,看重魁北克福利,加拿大联邦没有合适移民途径,打算留学移民的申请人可以考虑读魁北克法语课程走 PEQ 的方式。

加拿大联邦不会干涉魁北克的一刀切-飞出国

加拿大联邦是"一刀切"的始作俑者,加拿大联邦技术移民2006年9月实施的简化程序 SAP,2012 年3月30日出台一刀切,2008年2月27号227新政之前递交的还没有做出决定的申请人,91申请人等待6年得到被退回的结果。当时飞出国在博客就已经讨论过魁北克技术移民是否也会一刀切,现在魁北克终于效仿联邦,因此指望联邦政府为申请人说话的想法太天真,而且魁北克有自己独立的移民甄选权利,这个是联邦政府无权干涉的。当然最终的签证审批还是加拿大联邦政府说了算。

魁北克一刀切终止未处理申请不是针对或报复中国-飞出国

说魁北克9号法案是针对中国申请人或是报复中国当然是我们把自己看的太重要了,移民政策是针对全球的而不是针对一个国家的,中国申请人可能很多,魁北克移民部可能不喜欢某些中国申请人,但该政策是针对全球的,而且实施这个政策虽然有损形象但对魁北克社会是个好事,了解实情的魁北克当地居民会支持。

魁北克技术移民受影响申请人分析及对策-飞出国

魁北克2019年9号移民法案的核心是新移民系统能够给魁北克社会带来益处,魁北克依然欢迎能够很好融入魁北克当前的新移民,魁北克新的基于 EOI 意向申请然后由魁北克移民部择优录取的 Arrima 系统显然可以给魁北克移民部更大的移民部来筛选合格新移民。

条件好的申请人是受益者

  • 2016 年 613816 Mon Projet Quebec 抢上配额申请人的影响
    • 2016年两批抢上配额的申请中条件差的是最大受害者,他们失去了移民魁北克的机会
    • 2016年两批抢上配额的但在新政下条件还较好的申请人影响不大,有可能比之前速度快
  • 对之前没有提交申请或抢上配额对申请人也是有好有坏
    • 对条件一般的,因为之前抢上配额两批申请人加入竞争,或许要等更久才能获邀
    • 对条件较好对,由于取消了之前的积压,Arrima 系统可以更早邀请更快处理,速度会加快

因此,魁北克技术移民一刀切以后,由于丢掉了负担,Arrima 系统会很快开始邀请并快速处理,但如果条件一般短期内很难获得邀请,学习法语提分是是否关键的,另外就是考虑其他移民项目。

2019年2月7日魁北克国民议会9号移民法案 Quebec Regular Skilled Worker Program Immigration Bill 9 Act

今天在国民议会上介绍了通过成功融入移民来增加魁北克社会经济繁荣并充分满足劳动力市场需求的法案(PL9)。An Act to increase Québec’s socio-economic prosperity and respond adequately to the needs of the labor market through the successful integration of immigrants (PL9)

A new bill on immigration was introduced today in the National Assembly

The bill Loi visant à accroître la prospérité socio-économique du Québec et à répondre adéquatement aux besoins du marché du travail par une intégration réussie des personnes immigrantes (PL9) was introduced today in the National Assembly. The goal of this bill is to establish the necessary legal basis for improving the francization and integration of selected candidates as well as a better alignment of Québec’s labour needs with the profile of selected candidates.

The main objectives of the bill are as follows:

Improving the selection of immigrants

For immigration to contribute significantly to growing Québec’s prosperity and better responding to job market needs, the Ministère would like to benefit more immediately from the new system for managing immigration applications based on the statement of interest. To do this, the bill proposes terminating most of the applications for which a decision has not yet been rendered under the Regular Skilled Worker Program and reimbursing the applicants in question so that from this point on all new applications occur by invitation of the Minister, following submission of a statement of interest.

This provision of the bill seeks, in particular, to:

  • ensure a better alignment between job market needs and the profile of selected candidates;
  • benefit more immediately from the new system for managing immigration applications based on the declaration of interest, by inviting candidates who meet Québec’s needs;
  • reduce processing times for applications for permanent selection from skilled workers.

Note that applications for the addition of a spouse or a de facto spouse and applications for the addition of a child submitted by skilled workers who have already been selected are not targeted by this provision.

Improving the francization and integration of immigrants

The bill seeks to emphasize the importance of the process for integrating immigrants, in particular by clarifying the principle of the commitment shared between Québec society and immigrants. On the one hand, Québec society must be welcoming and inclusive and the government is responsible, in particular, for putting in place an effective and personalized offer of services for francization and integration. On the other, immigrants must commit to successfully carrying out the necessary steps for settling and integrating in Québec, including learning French as well as democratic values and Québec’s values, as set out in the Charter of Human Rights and Freedoms.

Strengthening Québec’s actions in the area of immigration

The Ministère wishes to pursue its efforts to fully exercise its powers of selection, particularly with the reintroduction of the enabling power that allows the Québec government to determine by regulation the conditions for permanent residence that the Minister can impose on the candidates selected. Québec also wishes to expand its scope of intervention, by ensuring better follow-up of the clients that use the services offered by its many partners.

Public consultations on the bill will begin shortly and will enable stakeholders in the milieu, such as francization, integration and immigration law organizations, to voice their opinions on the new orientations proposed by the government.

FAQ

Does Québec still want to welcome immigrants?

The eventual reimbursement of pending applicant files does not mean that Québec no longer wants to receive their applications. It’s rather that the old system had become ineffective, especially for applicants who had been waiting several years before their application was processed.

Obviously, we understand that an immigration application represents, in many cases, a life project, and that the persons affected by the provision that proposes the reimbursement of applications in the inventory may have concerns. We acknowledge that it is a disappointment for these persons who have been waiting for years and who have invested a great deal of time and energy into it.

Is it still possible to submit an application?

We encourage applicants who are already in Québec to file an expression of interest in Arrima. Their knowledge of the French language and their employment status in Québec may allow them to be invited to submit an application for permanent selection, according to the invitation criteria.

We also invite all foreign students and temporary workers to get informed on the Programme de l’expérience Québécoise (PEQ – Québec experience program) and to, if they meet the conditions, submit an application without delay. It is a simplified process to obtain access to permanent residence, which is not affected by Bill 9. For more details, consult the section Applying for permanent selection.

Certain applicants who are already in Québec and who are proficient in French may also be eligible for the Self-Employed and Entrepreneurs programs. In fact, persons who are proficient in French may file an application at any time under these programs. To learn the rules and procedures, consult the section Businesspeople.

When and how will applicants be reimbursed?

For the time being, the Bill has been introduced and the consultation process is ongoing. If the Bill is passed and assented to, we will communicate the information and details regarding reimbursement to the applicants affected.

I am a temporary resident in Québec. Does the Bill affect me?

If you are in Québec as a temporary resident and have a work permit from the Federal government, the possible adoption of Bill 9 does not have an impact on this permit. It is important, nonetheless, to follow the standard procedures required to renew your permit with Immigration, Refugees and Citizenship Canada before your work permit expires.

Un nouveau projet de loi en matière d’immigration déposé à l’Assemblée nationale

Le projet de Loi visant à accroître la prospérité socio-économique du Québec et à répondre adéquatement aux besoins du marché du travail par une intégration réussie des personnes immigrantes (PL9) a été déposé aujourd’hui à l’Assemblée nationale. Ce projet de loi vise à offrir les bases légales nécessaires pour améliorer la francisation, l’intégration et l’adéquation entre les besoins de main-d’œuvre du Québec et le profil des candidats sélectionnés.

Voici les principaux objectifs du projet de loi :

Mieux sélectionner les personnes immigrantes

Pour que l’immigration contribue de manière significative à accroître la prospérité du Québec et à mieux répondre aux besoins du marché du travail, le Ministère souhaite tirer profit plus rapidement du nouveau système de gestion des demandes d’immigration basé sur la déclaration d’intérêt. Pour ce faire, le projet de loi propose de mettre fin à la plupart des demandes pour lesquelles une décision n’a pas encore été rendue dans le cadre du Programme régulier des travailleurs qualifiés et de rembourser les demandeurs concernés afin que toutes les nouvelles demandes se fassent dorénavant par invitation du ministre, suite au dépôt d’une déclaration d’intérêt.

Cette disposition prévue au projet de loi vise notamment à :

  • Assurer une meilleure adéquation entre les besoins du marché du travail et le profil des personnes sélectionnées;
  • Tirer profit plus rapidement du nouveau système de gestion des demandes d’immigration basé sur la déclaration d’intérêt, en invitant les personnes qui répondent aux besoins du Québec;
  • Réduire les délais de traitement des demandes de sélection permanente de travailleurs qualifiés.

Précisons cependant que les demandes d’ajout d’un époux, d’une épouse, d’une conjointe ou d’un conjoint ainsi que celles d’ajout d’un enfant présentées par des travailleurs qualifiés déjà sélectionnés ne sont pas visées par cette disposition.

Mieux franciser et mieux intégrer les personnes immigrantes

Le projet de loi vise à souligner l’importance du processus d’intégration des personnes immigrantes, en clarifiant notamment le principe de l’engagement partagé entre la société québécoise et les personnes immigrantes. D’un côté, la société québécoise se doit d’être accueillante et inclusive et le gouvernement a, notamment pour responsabilité, de mettre en place une offre de services efficace et personnalisée en matière de francisation et d’intégration. La personne immigrante doit quant à elle s’engager à réaliser ses démarches d’installation et d’intégration, dont l’apprentissage du français ainsi que des valeurs démocratiques et des valeurs québécoises exprimées par la Charte des droits et libertés de la personne.

Renforcer l’action du Québec en matière d’immigration

Le Ministère souhaite poursuivre ses efforts pour exercer pleinement ses pouvoirs de sélection, notamment avec la réintroduction du pouvoir habilitant qui permet au gouvernement du Québec de déterminer par règlement les conditions affectant la résidence permanente que le ministre peut imposer aux personnes qu’il sélectionne. Le Québec souhaite également étendre sa portée d’intervention, en assurant un meilleur suivi de la clientèle qui utilise les services offerts par ses nombreux partenaires.

Des consultations publiques sur le projet de loi débuteront prochainement et permettront à des acteurs impliqués dans le milieu, comme des regroupements d’organismes en francisation, en intégration et en droit de l’immigration, de se prononcer sur les nouvelles orientations proposées par le gouvernement.

Foire aux questions

Est-ce que le Québec souhaite toujours accueillir des personnes immigrantes?

Le remboursement éventuel des dossiers en attente ne veut pas dire que le Québec ne souhaite plus recevoir leur candidature. C’est plutôt que l’ancien système était devenu inefficace, particulièrement pour les candidats qui attendaient de nombreuses années avant le traitement de leur demande.

Évidemment, nous comprenons qu’une demande d’immigration signifie dans plusieurs cas un projet de vie et que les personnes concernées par la disposition qui propose le remboursement des demandes en inventaire puissent avoir des inquiétudes. Nous reconnaissons que c’est une déception pour ces personnes qui sont en attente depuis des années et qui y avaient mis beaucoup de temps et d’énergie.

Est-ce qu’il est toujours possible de faire une demande?

Nous encourageons les candidats qui sont déjà au Québec à déposer une déclaration d’intérêt dans Arrima. Leur connaissance de la langue française et leur statut en emploi au Québec pourraient leur permettre d’être invités à présenter une demande de sélection permanente en fonction des critères d’invitation.

Également, nous invitons tous les étudiants étrangers ainsi que les travailleurs temporaires à s’informer sur le Programme de l’expérience québécoise, et s’ils remplissent les conditions, à présenter une demande dès maintenant. Il s’agit d’une voie simplifiée pour obtenir un accès à la résidence permanente qui n’est pas touchée par le projet de loi no 9. Certains candidats qui sont déjà présents au Québec et qui maîtrisent le français pourraient aussi se qualifier dans nos programmes pour Travailleurs autonomes et Entrepreneurs. Quand et comment les candidats seront-ils remboursés?

Pour le moment, le projet de loi a été déposé et le processus de consultation suit son cours. Si le projet de loi est adopté et sanctionné, nous communiquerons les informations et les détails relatifs au remboursement aux candidats concernés.

Je suis résident temporaire au Québec. Le projet de loi a-t-il une incidence sur moi?

Si vous êtes au Québec à titre de résident temporaire et possédez un permis de travail du fédéral, l’adoption éventuelle du projet de loi no 9 n’a pas d’incidence sur ce permis. Il est toutefois important de faire les procédures habituelles requises pour le renouvellement de votre permis auprès d’Immigration, Réfugiés et Citoyenneté Canada avant l’échéance de celui-ci.

2019年魁北克技术移民申请方案推荐-飞出国

飞出国:不仅是魁北克,对于加拿大联邦和澳洲来说,语言都成为新移民融入的最核心问题,而魁北克作为加拿大的法语区,法语将是魁北克移民甄选最重要的考核标准。2019年申请魁北克技术移民法语基本成为必须项。

魁北克9号一刀切终止之前技术移民申请的提案2019年正式实施问题不大。魁北克2018年815前没有开放另外的5000技术移民配额,4月1日那次承认是系统错误并撤销当次提交的申请,同时减少2019年移民配额,这些都为取消之前遗留申请,一刀切实施新的 Arrima 系统高分选打好了基础。

2018年8月2日之前魁北克一直实施的是先到先得的政策,申请人只要满足最基本打分标准同时抢上配额(无论是纸质还是在线)后面就是按部就班的等待审理。当然2019年2月魁北克一刀切政策实施后之前没有获得 CSQ 的申请被终止受理(魁北克移民部已经在着手给申请人退申请费),这批申请人只能重新递交新的 Arrima 系统 EOI 意向,然后根据分数情况等待获得系统邀请。

魁北克 job offer 也需要有法语基础并且最好当前已经在魁北克境内 - 飞出国

魁北克 job offer 最高可以获得 14 分的加分,蒙特利尔地区的 job offer 也可以获得8分加分,相当于2个12周之下子女的分数,但是,要获得魁北克技术移民的 job offer 加分并不十分容易,在当前魁北克移民部十分重视申请人法语的情况下,法语基础很差的申请人实际无法在魁北克获得合格工作机会,通过其他渠道获得的 job offer 也会被重点核查,另外获得魁省 job offer 也不一定达到 Arrima 系统的邀请分数,而申请人却需要提前办理工作签证去魁北克给雇主“工作”,而从获得魁北克 CSQ 邀请到拿到移民签证还需要2年甚至更长时间,在获得正式 CSQ 以前申请人理论上都要为雇主工作才保险。实际操作难度大。

留学魁北克可以极大增加魁北克移民的概率 - 飞出国

留学魁北克可以获得魁北克停留加分(有学制要求),同时魁北克专业有更多的受训加分(对高中毕业后就开始在魁北克读专科或本科的学生来说可选的专业更多),魁北克毕业后有机会找到 job offer 加分,在魁北克读书期间法语能力会提高,这些都是直接或间接的加分点。

魁北克 PEQ 项目仍然是稳定可靠的 - 飞出国推荐就读法语课程

魁北克技术移民这些年一直在上演闹剧,包括魁北克经验类移民也出现过面试,取消指定的法语培训机构,取消毕业前6个月可以提交申请这些政策,但魁北克经验类移民的核心政策一直是稳定的,如果能在魁北克工作一年且达到法语B2或在魁北克读1800学时的专科课程或学位课程并达到法语B2(就读法语课程的可以免法语考试)都是可以快速申请魁北克经验类移民的。

魁北克留学移民是少数毕业后不需要 job offer 就可以直接境内申请技术移民的项目,当然前提是法语好。飞出国推荐法语0基础或基础较差的申请人读实操性的法语类课程,这里非学术课程对学生的法语基础要求低,容易毕业且毕业后好找工作。申请人只需要先读10个月左右的法语达到5级(B1)水平就可以就读专业课。

如果打算就读英语课程飞出国建议去联邦地区,例如曼省,如果去魁北克读英语课程,在现在没有办法轻易拿到认可机构的法语B2证书的情况下,申请人很难一方面读英语专业课一方面把法语提高到B2。

魁北克经验类移民 PEQ 是相对稳定的,同时,假设 PEQ 政策有变化,申请人也可以通过魁北克常规技术移民来申请,有了魁北克学历加分,有了法语基础,都会增加申请人在 Arrima 系统里的竞争力。

法语B2和英语8777哪个更容易-飞出国

如果申请人打算尽快出国定居,例如考虑到子女教育问题的话,可以选择留学移民或雇主担保。这类对语言要求低。

如果不是急于出去,那么常规技术移民是比较灵活的方式,但现在情况下,大部分常规技术移民也都采用高分选(当前,加拿大新省 ns 还是先到先得,但紧缺职业清单只有10多个职业)。

魁北克技术移民还是申请人不错的选择。对大部分申请人来说飞出国的建议是努力学习法语达到B2比雅思考到8777更容易。当前法语考试竞争不大,很多主观题评分比较宽松,B2属于中等水平努力可以达到,尤其是魁北克技术移民重点考察听说,而不重视读写,可以通过重点强化在1-2年内达到B2水平,而8777属于高级水平,不仅要努力还需要天分,另外还需要运气。

从长远来看,如果打算移民加拿大,法语好可以申请的项目更多,法语好可以在加拿大更方便的生活。当然如果同时考虑新西兰和澳洲等纯英语国家,那么努力准备英语更合适。

加拿大的商业移民暂时不是太推荐,因为成本高,周期不断,材料准备复杂,且当前除了魁北克(资金来源要求严格,投资额高,周期长)和NB(政策随时停,配额少,有居住保证金,成本比雇主担保高,周期也比较久)外,其他省份都是先工签再转移民的项目,对很多申请人来说不是太合适。

澳洲和新西兰的技术移民和商业移民都也门槛比较高。魁北克还是可以通过子女努力可以成功的项目。

比起子女留学来说,父母移民可以给子女以后的生活提供更多选择而成本上一般也比移民要高。

技术移民的门槛已经越来越高,当前政策下对很多技术移民申请人来说,努力学法语是更合适的途径。学法语不容易,也正是因为不容易才更稳妥。
