飞出国： 今年3月份，澳洲南澳州政府宣布将会推出Designated Area Migration Agreement (DAMA) 指定区域移民协议的计划。 DAMA 协议是澳洲联邦政府制定的一项移民新计划，属于短期雇主担保482 签证里的Labor Agreement Stream分支，目的是为了吸引新移民前往澳洲偏远地区。DAMA计划适用于那些愿意与澳洲政府签订DAMA劳工协议的雇主们申请，而南澳州的雇主需要获得DAR Endoresment (南澳州移民局)的认可才能成为合资格的雇主。

相较于普通的482签证来说，DAMA协议扩大了可申请的职业清单以及降低了部分职位的部分要求。

南澳州DAMA雇主资格·飞出国

  1. 雇主必须填写在一年内他们所需的职位数量，并详细描述该职位和申请该工作时所获得的豁免特权内容；
  2. 雇主必须证明他们的总公司是设立在南澳州；
  3. 雇主必须证明他们已经合法经营该业务超过12个月；
  4. 雇主必须证明他们的财政状况是健康良好；
  5. 雇主必须证明他们所需要的职位是真实存在并且是真正空缺；
  6. 雇主必须完成劳动力市场测试 (LMT)；
  7. 就该地区目前的劳动力市场状况而言，雇主必须提供证据证明所需要的职位和申请该工作时所获得的豁免特权是合理的；
  8. 雇主必须提供合法的雇佣条款和条件；
  9. 雇主必须提供过去6个月内劳动力构成变化的详细信息；
  10. 雇主必须表明在申请该工作时所获得的豁免特权不会导致海外工人不能负担自己的生活或造成剥削；
  11. 雇主必须声明没有任何对公司造成影响的负面信息存在

关于如何准备这些文件，南澳州政府将会在2019年的7月公布更详细的信息给有兴趣申请DAMA的南澳州雇主们。

Endorsement Criteria

South Australian employers will be required to provide the DAR evidence the following criteria has been fulfilled:

  1. Employers will be asked to request the number of positions they need to fill in one year detailing the occupation(s) and concession(s) they seek
  2. Employers must show they are based in South Australia
  3. Are lawfully operating that business for more than 12 months
  4. Are financially viable
  5. Demonstrate the position is genuine and there is a genuine vacancy
  6. Labour Market Testing (LMT) has been completed in accordance with requirements. Refer to the Department for Home Affairs LMT factsheet
  7. Demonstrate requested occupations and concessions are reasonable with regard to current labour market conditions in the region
  8. Show employment terms and conditions are reasonable and lawful
  9. Provide detail on any recent changes to workforce composition in the last 6 months
  10. Show that concessions will not undermine Overseas Worker’s ability to support themselves or lead to exploitation
  11. Declare there is no adverse information about the employer.

Details on how to apply and supporting evidence required will be available from 1 July 2019

南澳州DAMA雇主资格申请流程概览·飞出国

  1. 南澳州雇主需要先申请DAR Endoresment，也就是首先向南澳州移民局提出申请；
  2. 南澳州移民局将会审核雇主的所有申请文件；
  3. 成功通过审核后，南澳州移民局将会发出一封通过审核的信给雇主并且通知澳洲移民局该雇主通过DAR Endorsement 南澳州移民局的审核；
  4. 雇主需要向澳洲移民局提出申请劳工协议；
  5. 澳洲移民局将会审核雇主的申请并通知申请结果；
  6. 成功通过审核后，雇主最后还需要向澳洲移民局递交提名和签证申请。

雇主申请表将于2019年7月1日于南澳移民局网站上生效。

Process Overview

The following diagram outlines the end-to-end process and parties responsible for each process stage.

  1. Employer applies for DAR endorsement
  2. DAR undertakes assessment for endorsement
  3. DAR issues a Letter of Endorsement to the employer and notifies Department of Home Affairs
  4. Employer requests DAMA Labour Agreement with the Department of Home Affairs
  5. Home Affairs assess Labour Agreement application and notifies employer of outcome
  6. Employer proceeds to lodge nomination and visa application with Home Affairs

南澳DAMA职业清单·飞出国

飞出国： 近日，南澳州政府官方公布了南澳DAMA职业列表，一共174个职业，第一年1050个申请名额，详细的申请流程和方法将于2019年7月1日公布。 这两个DAMA项目一共担保174个职业，其中有4个职业，占位代码为：ANZSCO 070499，不在ANZSCO清单上，但是也可以提名。

南澳政府DAMA为当地缺少经验丰富的技能人员和劳动力的雇主提供了担保海外申请人的框架。根据不同的职业，提供英语能力、工资、技能、经验以及年龄等方面的相应豁免，一定程度上降低了获得永久居住权的难度。

具体来说，南澳DAMA协议细分为Adelaide Technology and Innovation Advancement Agreement和South Australian Regional Workforce Agreement两种：

Adelaide Technology and Innovation Advancement Agreement 注重于阿德莱德地区的高科技增长产业包括国防、航天、科技和先进制造业，职业清单有60个职业，大伙儿比较熟悉的有2334电子工程师，2335机械、产业、生产工程师，2339工程技师，2612 网页开发师等。全部职业均可在后期满足相应要求后即可转永居通道，第一年接受最多300个申请人。

优惠政策：
该列表中的所有职业，转雇主担保永居签证（Subclass 186）的年龄限制均被放宽，最低放宽至 50 周岁以下，最高放宽至 55 周岁以下。

Adelaide Innovation and Technology Agreement

There are 60 occupations on the Adelaide Innovation and Technology Agreement which supports the Adelaide City Deal. These occupations provide employers in the defence, space, and advanced manufacturing and technology industries with the ability to access and retain a highly-skilled workforce.

The Adelaide City Technology and Innovation Advancement Agreement covers the Adelaide Metropolitan region only.

Concessions offered on this Agreement address specific challenges including, attracting a skilled workforce by offering pathways for permanent residency in South Australia. Following the required period of time on a temporary skilled visa talented individuals may be enabled to meet permanent residency by accessing the age concession when applying for the Employer Nomination Scheme (subclass 186) visa, subject to the occupation and concession being on the DAMA occupation list at time of application.

South Australian Regional Workforce Agreement注重于南澳偏远地区的农业企业、林业、健康和社会服务、旅游和酒店业、建筑业和矿业。职业清单有114个职业，其中餐饮类、农业类和技工类的职业比较多，包括3511面包师，3513大厨等。大部分职业可在后期满足相应要求后即可转永居通道，第一年接受最多750个申请人。

优惠政策：
针对不同职业，在工作经验、薪资要求、英语能力、年龄等方面会有不同的豁免权利，包括：

  1. 根据全澳设定的临时技术移民薪资要求 (TSMIT) 最多降低 10%；
  2. 语言能力可降至雅思均分4.5，单科不低于4.0（或其他相对应的英语测试）；
  3. 职业评估要求降低；
  4. 转永久居民签证的年龄限制，放宽至50周岁以下。

South Australian Regional Workforce Agreement

There are 114 occupations on the South Australian Regional Workforce Agreement which provide employers in key regional growth industries of agribusiness, health and aged care, hospitality and tourism, mining and construction sectors with the ability to access and retain a skilled workforce.

The South Australian Regional Workforce Agreement covers the entire state of South Australia.

Concessions for occupations vary and include:

  • Up to 10% reduction of the Temporary Skilled Migration Income Threshold (TSMIT), which is set nationally
  • English language concessions at IELTS (or equivalent in another accepted English language test) 4.5 with no less than 4.0 in any of the four test components
  • Skills assessment concession
  • Age concession to enable pathways to permanent residency

The South Australian Designated Area Migration Agreement also provides eligible businesses access to 4 occupations not listed in ANZSCO, these are identified under the code ‘ANZSCO 070499’.
