飞出国: 随着爱尔兰近年来经济迅猛的发展,越来越多的国际公司将爱尔兰作为欧洲总部的首选国家。但不少人才和企业在爱尔兰的配偶签证的问题上,希望爱尔兰政府能进一步的给予优惠,以便鼓励更多的人才留在爱尔兰本地工作。

根据爱尔兰现有的劳工法规定,目前非欧盟成员国的外国公民来爱尔兰工作需要办理工作签证,而陪同来的家属只能办理配偶签证(Stamp 3),然而根据移民局的现有规定,凡持有配偶签的外国公民在爱尔兰需额外申请配偶工作许可(DPSEP)。

这一签证在司法上的局限性使得很多有家庭的高级人才对在爱尔兰工作望而却步,已经成为了爱尔兰国家延揽人才的阻碍。

那么重点来了!

爱尔兰移民局今日公布最新法规:爱尔兰劳工部(DBEI)已经取消了配偶签证所需的工作许可,凡持有高技能工作许可签证(CSEP)的外国公民的合法配偶在被允许进入并居住在爱尔兰后,移民局将给予其工作签证(Stamp1),无需再向劳工部申请之前的配偶工作许可,便可直接进入劳务市场。新的政策于今天2019年3月6日(当地时间)起正式生效。

爱尔兰的商业企业创新部部长希瑟·汉弗莱斯称,“虽然这一签证目前所涉及人数每年不足1000人,但对爱尔兰在国际人才和投资方面产生了巨大影响。”高技能工作许可(The Critical Skills Employment Permit)本身就是为了吸引高端人才到爱尔兰来,但另一半如果无法获得工作许可,那么大部分这些家庭将选择离开爱尔兰。

对于普通工作许可(Stamp1)持有者的配偶、或是长居签证(Stamp4)的配偶则不在此政策范围之内,依然持有配偶签证(Stamp3)、且需要额外申请到配偶工作许可(DPSEP)之后才可以工作。

Revised immigration arrangements for the Spouses and De Facto Partners of Critical Skills Employment Permit Holders

Changes affecting non-EEA national spouses and de facto partners of persons who have permission to reside in Ireland on the basis of a Critical Skills Employment Permit (CSEP) take effect from today 6 March, 2019.

Prior to this change, spouses and de facto partners of CSEP holders were granted permission to reside in this State on Stamp 3 conditions.Where they also wanted to access the labour market, they needed to apply for a Dependant/Partner/Spouse Employment Permit (DPSEP) to the Department of Business, Enterprise and Innovation (DBEI).

The requirement to obtain a DPSEP has now been removed by DBEI. INIS will grant eligible spouses and de facto partners of CSEP holders permission to reside in this State on Stamp 1 Conditions without the need to obtain a DPSEP from DBEI. This means that eligible spouses and de facto partners of CSEP may access the labour market when they receive a Stamp 1, and do not need to obtain a DPSEP.

In addition, it is open to spouses and de facto partners of CSEP holders who are currently resident in Ireland on Stamp 3 conditions to attend their local immigration office to obtain a permission to reside on Stamp 1 conditions without the need for a DWP from DBEI.

On 1 April 2019, a new preclearance policy will be introduced for the non-EEA de facto partners of CSEP holders. Both visa and non-visa required nationals will be required to seek permission to reside in this State as the family member of a CSEP holder prior to their arrival in the State. The new procedure will reduce processing times and provide clarity for these family members. Eligible de facto partners will be granted residence on Stamp 1 conditions without the need to obtain a DPSEP from DBEI.

Ireland Critical Skills Employment Permit

The Irish Critical Skills Employment Permit is a job-offer based work permit which allows immigrants to work in Ireland in a role that pays at least €60,000 per year; or at least €30,000 per year if the job is on Ireland’s Highly Skilled Occupations List . Either the worker or the employer can apply for this visa.

Length of stay

Ireland’s Critical Skills Employment Permit is issued for a period of 2 years. After this period immigrants may apply for a Stamp 4, which allows them to live and work in Ireland on a permanent basis.

Job offer

The migrant worker must have an existing job offer in Ireland before applying for this visa, and must have all the appropriate skills, experience, and qualifications for the role. The employment contract must state that the permit holder will be employed for a minimum of 2 years.

Either the worker or the employer can apply for this visa. If the employer applies then they must plan to employ and pay the migrant worker directly; meaning employment agencies and the like cannot apply for a Critical Skills Employment Permit.

Labour Market Needs Test

Jobs offered to migrants through the Critical Skills Employment Permit scheme are not subject to the Labour Market Needs Test.

Minimum salary

Jobs offered to migrants through the Critical Skills Employment Permit scheme must pay a minimum of either:

€60,000 per year (in most cases), OR;
€30,000 per year (if the job is on Ireland’s Highly Skilled Occupations List)
